Terms of Use.

1. What this agreement covers

These terms govern your use of HeartCore — the iOS app, watchOS app, and any associated materials and services — during the pilot phase. By using HeartCore, you agree to these terms. If you do not agree, please don't use HeartCore.

2. Eligibility

You must be at least 18 years old and capable of entering a binding agreement. HeartCore is provided to invited pilot participants only.

3. HeartCore is not a medical device

HeartCore is a decision-state companion intended for general wellbeing and reflective use. It is not a medical device, not a diagnostic tool, and not a substitute for professional medical advice, diagnosis, or treatment.

HeartCore does not detect, predict, prevent, or treat any disease, disorder, or condition. The signals HeartCore reports are statistical observations about your physiology relative to your own personal baseline — nothing more. If you have a medical concern, please see a qualified clinician.

HeartCore must not be used in emergencies, in life-critical decisions, in safety-of-life systems, or by anyone who would depend on it for a clinically significant outcome.

4. Decisions are yours

HeartCore may surface state indicators, haptic cues, and reflection prompts. These are inputs to your judgment, not substitutes for it. You remain solely responsible for any decision you make in any setting — professional, personal, financial, or otherwise — whether or not you used HeartCore in the process.

5. Pilot status

HeartCore is in an unfinished pilot phase. You may encounter bugs, missing features, signal dropouts, false-positive cues, false-negative cues, or other behavior that doesn't match the marketing copy on this site. You acknowledge this and use HeartCore on that basis.

We may pause, modify, or end the pilot at any time. We will give active participants at least seven days' notice for any such change unless an urgent issue (security, App Store compliance) requires faster action.

6. Your account

If you sign in, you're responsible for keeping access to your account secure (your magic-link email, your Google account, your device passcode). If you suspect unauthorized access, tell us at heartcore@zwirs.co.

7. Acceptable use

You agree not to:

  • Use HeartCore for any unlawful purpose.
  • Use HeartCore on someone else's biometric data without their explicit, informed consent.
  • Attempt to extract proprietary detection logic via reverse engineering beyond what is permitted by applicable law.
  • Use HeartCore for surveillance of any person, including employees.
  • Resell HeartCore, sub-license its functionality, or present it as your own.

8. Intellectual property

HeartCore, including the name, brand, source code, scoring algorithm, and design system, is owned by us. You receive a limited, personal, non-transferable, revocable license to use HeartCore during the pilot. The data about you remains yours; see the Privacy Policy for how it is handled.

9. No warranty

HeartCore is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not guarantee that HeartCore will be uninterrupted, secure, or free of errors.

10. Limitation of liability

To the maximum extent permitted by law, in no event will HeartCore or its operators be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, data, or business opportunities — even if advised of the possibility of such damages.

Where liability cannot be excluded under applicable law, our total cumulative liability to you for any claim relating to HeartCore is limited to the greater of (a) the amount you have paid us in the past twelve months (during the pilot, this is zero) and (b) one hundred euros.

11. Indemnification

You agree to indemnify and hold us harmless from any claim or demand made by a third party arising out of (i) your misuse of HeartCore, (ii) your violation of these terms, or (iii) your violation of any third-party right.

12. Termination

You may stop using HeartCore at any time by uninstalling the app and (optionally) emailing us to delete your account. We may terminate or suspend your access to the pilot at any time for any reason, including breach of these terms. Termination does not affect rights or obligations that survive by their nature (intellectual property, limitation of liability, governing law).

13. Governing law

These terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. The courts of Amsterdam, the Netherlands, have exclusive jurisdiction over any dispute that is not first resolved informally — except that you may bring a claim in your local courts if mandatory consumer- protection law requires it.

14. Changes

We may update these terms. We will post the updated terms here and notify active pilot participants by email at least seven days before they take effect. Continued use of HeartCore after that date constitutes acceptance.

These terms are a first draft authored by HeartCore for the pilot phase. They have not yet been reviewed by external legal counsel. Before HeartCore is released outside the pilot, these terms will be reviewed by counsel and the company entity, governing law, and specific consumer-protection clauses may change.
